Representative Cases
Mr. Leunig has tried numerous cases to conclusion in both State
and Federal Courts. He has also brought countless challenges to the
State's evidence which have been successful and led to either the
complete dismissal of all charges or a reduction in the level of the
charges.
Acquittals and Dismissals
Murder
Intentional Murder charge. Following client's extradition
from the State of Washington, client was acquitted of Murder
after a nearly month long trial.
Criminal Sexual Conduct
Multi-count criminal sexual conduct complaint against client
alleging rape and other sexual crimes against two separate
victims. Client was acquitted of all charges after a lengthy
trial.
Felony Fleeing a Police Officer
Felony fleeing a police officer charge against client.
Although client hired Mr. Leunig only three days prior to trial,
client was acquitted after a one week jury trial. Criminal Sexual Conduct involving
children
Multi-count criminal sexual conduct complaint against client
alleging rape and other sexual crimes against two family
members. Client was acquitted of all charges after a lengthy
trial.
Criminal Sexual Conduct involving child
Criminal Sexual Conduct charges against client alleging rape
of his daughter. After a trial that lasted several weeks, the client was acquitted
of all charges.
Assault
Client was charged with felony assault after being involved in a
fight in a bar. At the conclusion of trial the client was
acquitted of all charges.
Driving Under the Influence
Client was charged with Driving under the Influence of
Alcohol and was acquitted following a trial. Driving
Under the Influence with a Prior Conviction
DWI case where the client had a prior offense. After a
contested hearing the Court ruled in the client's favor which
led to the criminal case being completely dismissed. Felony
Narcotics Charges
Client charged with felony controlled substance possession.
After a contested hearing the court certified the search and
seizure as "important and doubtful". After going up to the Court
of Appeals and prevailing, the serious drug charges against the
client were completely dismissed. Driving Under
the Influence
After a contested hearing in which the constitutionality of
the vehicle stop was challenged, the court ruled in the client's
favor and all of the DWI charges were dismissed.
Negotiated Pleas
Mr. Leunig has successfully negotiated the resolution of
hundreds of cases during his years in practice. He has achieved
outright dismissals in Felony, Gross Misdemeanor and Misdemeanor
cases, and has received significant reductions in the
seriousness of charged offenses and subsequent punishment as the
result of his well-honed negotiation skills. In one
representative felony drug case after considerable negotiations
with the prosecution, a client involved in his fourth felony
matter who was facing a presumptive multi-year prison sentence
received a local jail sentence with eligibility for work
release.
In another serious felony, drug possession and
production case, the County Attorney agreed to dismiss all
charges just prior to a contested evidentiary court hearing
based on the arguments set forth by Mr. Leunig. And in a Federal
drug importation case, the prosecutor dismissed the case
outright shortly before trial based on spirited and aggressive
pretrial representation by Mr. Leunig. In a serious
rape and assault case involving the use of a weapon, Mr. Leunig
engineered the complete dismissal of the rape charges and the
client pled to a lesser offense and served no time in jail.
In cases too numerous to list, DWI-related charges have been
totally dismissed with pleas being entered to non-alcohol related
charges such as careless or reckless driving.Likewise, in cases
involving prostitution and lurking, Mr. Leunig has frequently
been successful in keeping these embarrassing charges completely
off his clients' records.In Domestic Assault cases Mr. Leunig has
consistently negotiated agreements that keep this serious and
embarrassing charge off of his clients' records. In another case, on the day scheduled for jury trial,
Mr. Leunig obtained a continuance for dismissal in a Felony Terroristic Threats case, meaning that as long as the client had
no new charges in the next year, the entire case would be
dismissed.
These are but a few examples of serious criminal
charges that have been very successfully negotiated to achieve
outcomes in the clients' favor. These sorts of results come from
meticulous planning and preparation, rigorous and intelligent
negotiating, and the willingness and ability to go to trial if
the need arises.
